Overview

This document together with the documents it refers to tells you the Terms under which you may make use of the Marketplace Services provided via Our Site. Please read these Terms carefully before you make use of the Marketplace Services.

By registering to access the Marketplace you agree to be bound by these Terms. These Terms shall apply each time you use our Marketplace Services (unless otherwise agreed in writing) and shall prevail over any inconsistent terms or conditions contained, or referred to, in your standard terms of business or any other document supplied by you, or implied by law, industry custom, practice or course of dealing.

In the event of any dispute between your standard terms of business and these Terms, these Terms shall prevail. We reserve the right to change these Terms at any time with notice, by posting changes online and/or by email to the registered email ID. You are responsible for checking these Terms whenever you access the Marketplace to ensure that you are aware of any changes.

Your continued access to and use of the Marketplace after changes are posted constitutes your acceptance of the amended Terms. If you do not wish to be bound by these Terms and Conditions, please do not register or use this website.

By accepting these Terms you warrant that you have full capacity and authority to enter into and perform an agreement with us to use the Marketplace Services, and are duly authorised to bind the party for whom you act. You should print a copy of these Terms for future reference.

Please also read our general website terms and conditions and privacy policy. If you intend to use our wider services, additional service-specific terms may also apply.

Data Protection Laws: The EU General Data Protection Regulation 2016/679 (GDPR), the Data Protection Act 2018 and any applicable statutory or regulatory provision, as amended or updated from time to time, together with all relevant European Directives and regulations relating to the protection and transfer of personal data.

For the purpose of these Terms of Use, wherever the context so requires, “You” or “User” shall mean any natural or legal person who has agreed to become an Employer or Recruiter on the Website by providing registration data while registering on the Website as a registered user using the computer systems. The term “We”, “Us”, “Our” shall mean Recruiting Hub.

Membership Eligibility

By registering to access the Marketplace you agree to be bound by these Terms. These Terms shall apply each time you use the Marketplace Services unless otherwise agreed in writing.

Employers / corporates can only register as an Employer and a freelance recruiter or recruitment agency can only register as a Recruitment Agency on our site. Recruitment Agencies are not permitted to register as an Employer in order to post vacancies on Our Site.

By accepting these Terms, you warrant that you have full capacity and authority to enter into and perform an agreement with us to use the Marketplace Services, and are duly authorised to bind the party for whom you act.

Information About Us

The domain name www.recruitinghub.com and the mobile app Recruiting Hub are owned by Recruiting Hub Ltd, a company incorporated in England & Wales under the Companies Act 2006, having its UK office at Peterborough.

Overseas licensing authority of Recruiting Hub is held by the parent company Recruiting Hub Ltd. Recruiting Hub is the trading name of Recruiting Hub Ltd in the UK (Company No. 12677584 / VAT No. GB363347982), Recruiting Hub India Pvt Ltd in India, Recruiting Hub Tech FZCO in UAE, and Recruiting Hub US LLC in the US.

For the avoidance of doubt, Recruiting Hub is not acting as an employment agency as defined in the Employment Agencies Act 1973. Recruiting Hub provides an online platform for Employers and Recruiters to meet and is not involved in the actual transaction between Employers and Candidates or Contractors.

Definitions and Interpretation

Account: By registering on the Marketplace, as either an Employer or Recruiter, you are creating an account which will contain your activity on the Marketplace.
Agreement: The agreement between Us and you pursuant to which you make use of the Marketplace Services, the terms of which are set out in these Terms.
Candidate: A person or an independent contractor introduced or submitted by the Recruiter to the Employer through the Platform / Marketplace Services to be considered for an Engagement.
Employer: Any person or organisation using the Marketplace Services to post one or more Vacancies with a view to employing a Candidate.
Engagement: The act of an Employer accepting a Recruiter’s engagement request via the Marketplace to submit candidate(s) to their Vacancy.
Fee Period / CV Ownership: The period a Recruiter is deemed to have ownership of a Candidate, which shall be 6 months from the date of submittal of such Candidate’s CV to the Marketplace.
Handling Fee: The fee that We deduct from the Recruiter’s Placement Fee for the Marketplace Services We provide.
Marketplace: The marketplace contained within Our Site in which Employers may post Vacancies and source Candidates and Recruiters may submit Candidates to Vacancies.
Marketplace Service: The provision by Us of the Marketplace, as further described on Our Site from time to time.

Placement: Employment or engagement of a Candidate by or on behalf of the Employer following the introduction of that Candidate by a Recruiter via the Marketplace.
One Off Placement Fee % for Permanent Hires: The fee set by the Employer and payable only upon a successful hire. Once set, the fee may be increased but not reduced without Our written consent. Available ranges typically sit between 7% and 25%, subject to country rules.
Contract Roles (Cost+ or Markup): Commission is monthly ongoing / recurring for the duration of the contract. Our margin on top of candidate rate generally ranges between 20% and 25%.
Contract to Hire Transfer Fee: Where a contractor is moved to permanent employment, a transfer fee may apply, typically between 10% and 15% of the offered first-year annual salary.
RPO Services with a Retainer Fee: A retained recruitment model used for larger hiring volumes, normally involving an upfront retainer tied to agreed hiring scope.
Free Replacement Guarantee for Permanent Recruitment: One-time free replacement guarantee for 60 or 90 days from candidate date of joining, or as otherwise agreed in principle with the Employer, provided the Placement Fee has been paid within the terms of this agreement.
Replacement Period: The period calculated by reference to the candidate’s start date and termination date during which an Employer may be entitled to one free replacement, subject to the agreed commercial terms.
Recruiter: Any person or organisation using the Marketplace Services to introduce one or more Candidates to Employers in respect of any Vacancy.
Recruiter Fee: The fee payable to the Recruiter upon a Placement, calculated as the Placement Fee minus Our Handling Fee, payable once We have received the Placement Fee from the Employer and the candidate has satisfied the agreed replacement / guarantee conditions.
Start Date: The date on which a Candidate commences employment or engagement with an Employer.
Terms: These terms and conditions under which you may make use of the Marketplace Services.
Vacancy: A job vacancy posted by the Employer on the Marketplace.

In these Terms, words importing the singular shall include the plural and vice versa, and words importing the masculine gender shall include the feminine gender and vice versa.

Any reference to a statute, statutory provision or subordinate legislation shall be construed as including a reference to that statute, provision or legislation as from time to time modified, consolidated, superseded, re-enacted or replaced.

Status and Registration

Status

Nothing in these Terms will create a partnership or joint venture between us. We are an independent provider of services to you and are not employed by you.

Registration

In order to use the Marketplace Services, the Employer and the Recruiter must register with Us. We may accept or reject each application to register at our discretion, and may cancel such registration at any time if the Employer or Recruiter is in breach of these Terms.

Obligations of the Employer

  • The Employer agrees that Recruitment Agencies have 6 months CV ownership over submitted candidates if feedback is not updated and/or a duplicate is not raised within 48 hours of CV submission and the candidate is recruited within 6 months from the date of CV submission.
  • The Employer agrees to notify Us immediately when an offer of employment has been accepted by a Candidate, including updating candidate DOJ and offer amount on the portal where applicable, so that the correct invoice can be raised.
  • The Employer shall satisfy itself as to the suitability of any Candidate for the Vacancy within 48 hours of CV submission by Recruiters.
  • The Employer is responsible for checking references, validating qualifications, confirming work rights, medical requirements and any other suitability checks required by law or role.
  • The Employer shall use best endeavours to keep confidential any confidential information of any Candidate, including CVs and related application information.
  • If a Candidate initially rejected by the Employer is later employed within six months of initial introduction, the Employer remains responsible for the Placement Fee.
  • If the Employer introduces the Candidate, directly or indirectly, to another person, firm, company, subsidiary or associated company and that party engages the Candidate within six months of initial introduction, the Employer remains responsible for the applicable fees.
  • The Employer consents to the disclosure by Us to Recruiters and Candidates of information relating to the Employer which the Employer has provided to Us.
  • In the event of non-payment by the Employer of the Placement Fee, the Employer agrees that We may assign the debt relating to such non-payment to the Recruiter.
  • If the Employer claims prior ownership of a Candidate CV from another source, the Employer is solely responsible for providing proper evidence. Our decision on such disputes shall be final and binding.
  • The Employer shall inform Recruiting Hub if a Recruiter contacts it directly, online or offline, to work around or circumvent the Marketplace Services.
  • If the Employer deletes its account, Recruiting Hub may retain relevant submission data for up to 6 months to protect platform ownership rights and commercial obligations attached to those submissions.

Obligations of the Recruiter / Recruitment Agency

  • The Recruiter warrants that they are a professionally trained recruiter, are suitable to act as an Employment Agency and agree to comply with relevant employment agency regulations.
  • When engaged with an Employer on the Marketplace, the Recruiter shall not use the Employer’s company name or brand publicly when advertising the Employer’s vacancy and searching for Candidates.
  • The Recruiter will use reasonable endeavours to introduce suitable Candidates who meet the Employer’s vacancy specification.
  • The Recruiter agrees to properly screen Candidates and obtain confirmation from the Candidate that they are willing to work in the position before submitting the CV.
  • Recruiting Hub does not guarantee the contents of an Employer’s job posting. Recruiters are responsible for validating job details before sourcing candidates.
  • All CV submissions for vacancies must be sent through Our Site. Any attempt to circumvent Our Site may lead to account termination and forfeiture of recruiter entitlements.
  • The Recruiter agrees not to directly or indirectly work around, avoid, circumvent or otherwise exploit the Marketplace Services or Our Site with the intent or effect of depriving Us of due compensation, handling fees or placement fees.
  • The Recruiter shall not directly approach Employers introduced through Recruiting Hub for a period of 12 months other than through permitted communications linked to the posted vacancy.
  • If a Recruiter is found to have circumvented the platform, the Recruiter may be liable to pay specified penalties depending on the applicable country entity and fee model.
  • Candidates are represented by the first Recruiter to submit the Candidate through Our Site, provided the Recruiter had permission from the Candidate to submit them.
  • Where a prior-source dispute arises, Recruiting Hub will investigate and determine whether a Placement Fee is due. Our decision shall be final.
  • Provided the Employer is not already aware of the Candidate and evidence supports that position, the Recruiter shall have ownership of that Candidate for six months from first submission.
  • If the Recruiter deletes their agency account, they may lose all monetary benefits relating to submissions made during the last 6 months, and Recruiting Hub may retain transfer copies of the submission data.

Placement Fees, Contract Terms and Replacement

Placement Fee for Permanent Recruitment

Where a Candidate is submitted via the Marketplace and is successfully appointed in a posted Vacancy, or within any other role within the Employer’s organisation or group, We will invoice the Employer on behalf of the Agency upon confirmation of candidate acceptance.

The Placement Fee is generally payable within 30 days. If the Candidate does not commence the engagement, the Placement Fee shall not be payable and, if already paid, may be refunded and/or credited in line with agreed terms.

The Employer will remain liable for the Placement Fee in respect of a Candidate if within 6 months of introduction:

  • the Employer employs that Candidate on a permanent or temporary basis; or
  • the Employer initially rejects the Candidate but later employs or engages them; or
  • the Employer refers the Candidate to another entity in its group and that entity employs or engages the Candidate.

Contract Roles

Contract roles operate via an end-rate / cost-plus / markup structure. In many cases, the client pays the agreed amount monthly against approved time sheets, and funds are then distributed according to the relevant commercial split.

Examples of contract commercial models may include standard 80:10:10 or other agreed split structures, depending on end-rate, candidate rate, payroll setup, legal entity coverage and local market arrangements.

Contract to Hire Transfer Fee

Where a contractor is converted into a permanent employee, a transfer fee may apply, generally ranging between 10% and 15% of the candidate’s offered first-year annual salary, unless otherwise agreed.

RPO Services

RPO services may involve a retainer fee arrangement, often including an upfront portion of the projected placement fee and an account management layer to support volume hiring.

Free Replacement

The Replacement Period shall run from the Candidate Start Date and may be 30, 60 or 90 days, or any other period agreed in principle with the Employer.

The Employer may be entitled to a one-time free replacement, provided:

  • the Placement Fee has been paid within 30 days unless otherwise agreed in writing;
  • termination was not caused by redundancy, restructuring, pregnancy, injury, ill health, age, race, gender, sexual orientation or disability;
  • termination did not arise from unfair or bad-faith hiring intentions by the Employer; and
  • the Employer gives notice to Us within the agreed notice window, usually 7 days.
Replacement Window Replacement Benefit

If the Employer fails to pay the Placement Fee within 30 days from invoice date, the Employer may lose the benefit of replacement provisions.

Recruiter Fee / Handling Fee

Upon successful Placement, We may invoice the Employer on behalf of the Agency for the Placement Fee specified on the Vacancy. We reserve the right to deduct Our Handling Fee before passing the Recruiter’s share onward.

Where applicable, funds may be held during the agreed replacement period before release in line with the replacement schedule.

Termination and Recruiter-On-Demand Services

Recruiter Termination

We may terminate or suspend any and all services and access to Our Site immediately, without prior notice or liability, if you breach any of the terms or conditions of the agreement. Upon termination of your account, your right to use the services and access Our Site will immediately cease.

All provisions of the agreement which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers and limitations of liability. If we withdraw access to the Marketplace because these Terms have been breached, no refund will be payable by us.

Recruiter-On-Demand Services to Employers

“Hire a Recruiter” is a fixed-fee service payable by an Employer to hire a recruiter from our marketplace to fill vacancies for a monthly fixed cost payable in advance using our online payment methods.

Subscription fees, plans, usage benefits and pricing may be varied from time to time. Upgrades may take immediate effect, while downgrades may apply from the next calendar month. We shall be under no obligation to refund any subscription fee if cancelled unless specifically stated otherwise.

AI Recruiter – Additional Terms of Use

1. Scope of Service

AI Recruiter is an artificial intelligence-enabled feature provided by RecruitingHub to assist with candidate discovery, screening, ranking, and recruitment-related insights. AI Recruiter provides decision-support only and does not replace human judgment.

2. No Solely Automated Decision-Making (GDPR Article 22)

AI Recruiter does not engage in solely automated decision-making within the meaning of Article 22 of the GDPR. All outputs generated by AI Recruiter are assistive, non-binding recommendations intended to support human decision-making. Users are required to apply meaningful human review before taking any employment-related action.

3. Data Processing & Lawful Use

AI Recruiter processes recruitment-related data solely for the purpose of delivering its functionality.

  • Users confirm they have lawful authority and valid consent to upload and process candidate data.
  • Users confirm the data shared complies with the Information Technology Act, 2000, SPDI Rules, GDPR and other applicable law where relevant.
  • Users confirm no data is uploaded in violation of applicable employment, privacy or data protection laws.

For candidate personal data processed via AI Recruiter, the user acts as the Data Controller and RecruitingHub acts as the Data Processor.

4. Access, Subscription & Usage Limits

  • Access to AI Recruiter is subject to active subscription plans, usage limits and commercial terms as published from time to time.
  • RecruitingHub may introduce, revise or discontinue pricing plans.
  • RecruitingHub may apply fair usage limits, feature restrictions or throttling.
  • RecruitingHub may suspend or restrict access for non-payment or policy violations.

5. Fair Use & Compliance

Users shall not use AI Recruiter for discriminatory, unethical or unlawful hiring practices, unlawful automated profiling, scraping, reverse engineering or misuse of outputs.

AI Phone Screening – Candidate Contact & Opt-Out Responsibility: candidates may be contacted for phone screening on behalf of your company. If a candidate requests not to be contacted again, the opt-out request may be recorded in screening comments and call notes visible within the platform. It is the sole responsibility of the Company to review such notes, remove such candidates from their pool and ensure compliance with communication and data protection regulations. RecruitingHub and its AI systems are not responsible for removing candidates from the Company’s pool following such a request.

6. Data Security & Retention

RecruitingHub implements reasonable technical and organizational security measures as required under applicable law. Data is retained only for as long as necessary to provide the service or comply with legal obligations.

7. Disclaimer & Limitation of Liability

AI Recruiter outputs are provided “as is” without warranties of accuracy, fitness or outcome. RecruitingHub shall not be liable for hiring or employment decisions, bias, errors or omissions in AI-generated insights, or any indirect, incidental or consequential damages arising from use of AI Recruiter.

8. Changes & Availability

RecruitingHub may modify, suspend or discontinue AI Recruiter features at any time. Continued use constitutes acceptance of updated terms.

9. Acceptance

Use of AI Recruiter constitutes acceptance of these Additional Terms, the main Terms of Service, and the Privacy Policy.

AI Recruiter is an assistive technology and must not be used as the sole basis for employment-related decisions.

Privacy Policy Addendum – AI Recruiter

1. Purpose of Processing

AI Recruiter processes personal data solely for recruitment assistance, including candidate matching, ranking, screening insights and workflow optimisation.

2. Categories of Data Processed

  • Candidate names, contact details, resumes and employment history.
  • Skills, experience, qualifications and job-related metadata.
  • Job descriptions and hiring criteria provided by users.

RecruitingHub does not intentionally process special category data unless explicitly provided by the user.

3. Legal Basis for Processing

  • Consent or legitimate interest (GDPR Article 6), where applicable.
  • Contractual necessity for subscribed services.
  • Compliance with the Information Technology Act, 2000 and SPDI Rules, 2011.

Users act as Data Controllers. RecruitingHub acts as a Data Processor.

4. No Solely Automated Decisions

AI Recruiter does not perform automated decision-making that produces legal or similarly significant effects on individuals. All outputs require meaningful human assessment and validation.

5. Data Retention

Personal data processed through AI Recruiter is retained only for as long as necessary to provide the service, meet contractual obligations or comply with applicable law.

6. Data Security

RecruitingHub applies reasonable security practices and safeguards in accordance with applicable law, including GDPR Article 32 where relevant.

7. Data Sharing

RecruitingHub does not sell or trade candidate personal data. Data may be shared only with authorized service providers strictly for service delivery and compliance purposes.

8. User Responsibilities

  • Users must ensure lawful collection and consent for candidate data.
  • Users must comply with applicable employment and data protection laws.
  • Users must respect candidate rights, including access, correction and erasure where applicable.

AI Recruiter is an assistive technology and must not be used as the sole basis for employment-related decisions.

Applicable Law, Jurisdiction, Copyright and Cookies

Applicable Law

Terms of Use shall be governed by and interpreted in accordance with the laws of the countries where Recruiting Hub has legal entities. The place of jurisdiction shall be exclusively in cities where Recruiting Hub has legal entities.

Jurisdictional Issues / Sale in Countries Where We Have Legal Entities Only

Unless otherwise specified, services on the Website are presented solely for sale in countries where Recruiting Hub has legal entities, including the UK, UAE, US and India. Users accessing from other jurisdictions do so at their own initiative and risk.

Trademark, Copyright and Restriction

This site is controlled and operated by RecruitingHub.com and services are sold by respective Recruiters. All material on this site, including images, illustrations, audio clips and video clips, are protected by copyrights, trademarks and other intellectual property rights. Material on the Website is solely for your internal, non-commercial use.
